1) HOW TO ENTER: The Sweepstakes begins 12:00 AM (eastern time) on December 20, 2004 and ends April 1, 2005 at 11:59 p.m. (eastern time). The Sponsor of the Sweepstakes is Mount Cranmore Ski Resort, Inc., One Skimobile Road, North Conway, NH 03860, owner and operator of Cranmore Mountain Resort. The Sweepstakes is subject to the specific restrictions, qualifications and other information contained in these Official Rules and by entering you agree to be bound by these Official Rules. To enter, complete and submit electronically the entry form located on-line at http://www.cranmore.com/winter/skivaca.asp. You will be asked to provide your first and last name, e-mail address, mailing address, ZIP code and phone number. All entries must include a valid e-mail address. ONLY ONE ON-LINE ENTRY PER PERSON WILL BE ACCEPTED FOR THE SWEEPSTAKES. Sponsor must receive all entries by 11:59 p.m. (eastern time) on April 1, 2005. Odds of winning depend on the total number of eligible entries received by Sponsor.
2) ENTRY CONDITIONS: The Sweepstakes is subject to all federal, state, and local laws and regulations and is void where prohibited. There is a limit of one Sweepstakes entry per person. Incomplete, inaccurate, or illegible entries are void. Use of any automatic or like entry method is prohibited. Proof of emailing an entry does not constitute proof of receipt by Sponsor. When entering the Sweepstakes you will be asked to voluntarily provide personal information to Sponsor to be used to send you information or updates about special offers, promotions, services and other items that might be of interest to you. If you check the appropriate box on the Sweepstakes entry form, you are "opting in" to receive such information from Sponsor via email, however, you may "opt out" from receiving such information by not checking such box on the Sweepstakes entry form. 3) WHO CAN ENTER: The sweepstakes is open only to entry by LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (except Rhode Island, Florida and everywhere else where it is prohibited by law) WHO ARE 18 YEARS OF AGE OR OVER AS OF THE DATE OF ENTRY and WHO HAVE INTERNET ACCESS AS OF December 20, 2004. Employees of Sponsor and its parent and affiliates and their immediate families (parent, child, siblings, spouse) and members of the same household (whether related or not) of such persons are not eligible to enter or win. No purchase necessary to enter or win.
4) PRIZE: One (1) Grand Prize will be awarded. The Grand Prize is one vacation package comprised of, subject to the below-described exclusions/limitations/blackouts, five nights of lodging at Cranmore Mountain Resort, New Hampshire for four people in one slopeside condominium chosen by Sponsor; five sequential days of non-transferable Cranmore lift tickets and ski or snowboard rentals for same four people, and one group snowsports lesson for each of the same four people; $50 gas card; and $100-value dinner, for the same four people during the same stay, at Horsefeathers Restaurant located in North Conway, NH. The Grand Prize is subject to the following Grand Prize Exclusions/Limitations/Blackouts: the lodging is available only upon prior reservations with Sponsor's Marketing Director, stay must occur Sunday through Thursday nights during the 2005/2006 Cranmore Mountain Resort ski and snowboard season, subject to availability, excluding the following blackout dates: December 23, 2005-January 1, 2006, January 13-16, 2006 and February 17-27, 2006; Prize expires on the last day of the ski season, or May 1, 2006; whichever comes first. Prize is non-transferable and has no cash value; the last night of the lodging stay must be the night prior to Cranmore Mountain Resort's 2005/2006 closing day; the dinner is limited to $100 value, excluding tax and gratuity which the winner must pay. Total approximate retail value of Grand Prize is $1,300. The Grand Prize is not redeemable for cash or any other good or service. The Grand Prize is not transferable or assignable and no substitution is allowed except by Sponsor at its sole and absolute discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the Grand Prize is unavailable. Any expenses not explicitly listed herein, including any applicable tax (such as federal and state income tax) on the Grand Prize, are the sole responsibility of the winner.
5) LIMITATIONS AND CONDITIONS: By entering the Sweepstakes, you release Sponsor, its parent and affiliates and the prize supplier, if different, and their respective officers, directors, shareholders, contractors and employees from and against all claims, actions, injury, loss or damage of any kind resulting from or arising out of: (a) damage to a user's hardware, software or transmission lines due to participation in the Sweepstakes or to downloading any information or software necessary to participate; (b) incorrect transcription of information, human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion or defect, failure of or delay by any network, computer equipment, software or service, inability to access any website or on-line service, theft, tampering, destruction or unauthorized access to or alteration of entries, or any other error or malfunction associated with the Sweepstakes, (c) your entry or other participation in the Sweepstakes or from your winning or using the Grand Prize, if applicable. Sponsor reserves the right, in its sole discretion, to suspend or terminate the Sweepstakes at any time if a computer virus, bug or other technical problem corrupts the administration, security or proper play of the Sweepstakes. If Sponsor determines, in its sole and absolute discretion, that there is any suspected or actual electronic tampering with the Sweepstakes or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right to void the entries at issue and/or modify, suspend or terminate the Sweepstakes and conduct a random drawing to award the Grand Prize using all eligible non-suspect entries received as of the termination date. If the Sweepstakes is terminated due to tampering or technical problems prior to its stated ending date, notice will be posted at http://www.cranmore.com/info/winter/wintersweep.asp. Any attempt to deliberately damage or manipulate the content or operation of the Sweepstakes, or any related website or other property, is unlawful and subject to criminal and civil legal action by appropriate entities. As a condition of participating in this Sweepstakes, you agree that disputes which cannot be resolved between us, and any cause of action arising out of this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a State of New Hampshire court of competent jurisdiction, which court shall apply State of New Hampshire laws without regard for doctrines of conflict of law; under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than your actual out-of-pocket expenses (i.e., your costs associated with entering this sweepstakes), and you further waive all rights to have damages multiplied or increased.
6) SELECTION OF WINNER: The Sweepstakes prize winner will be selected in a random drawing, held within one month of the end of the Sweepstakes, from among all eligible entries received. The drawing will be conducted at the Sponsor's headquarters. All Sponsor's decisions relating to the Sweepstakes are final. The winner will be notified by e-mail or phone within one week of drawing. If the winner cannot be contacted within two business days of the first attempt, or if the winner fails to comply with these Official Rules, the winner forfeits the prize and the prize will be awarded to an alternate winner drawn at random from the remaining entries. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. To claim the prize, the winner will be required to sign and return an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release, within five days of issuance. Failure to return these documents in the stated time will result in disqualification of the winner, forfeiture of the prize and Sponsor drawing an alternate winner at random from the remaining entries. If the winner is ineligible or otherwise unable to participate or accept the Grand Prize for any reason, Sponsor shall have no further obligation to the winner. The winner may request and receive from Sponsor evidence that the prize matches the prize selected for that recipient. The prize will be awarded provided it is properly claimed in accordance with these Official Rules.
